Hertfordshire County Council must not sell or lease land to HelioSlough

PLEASE SUPPORT THIS PETITION, as we believe it affects all residents of Hertfordshire.

We the undersigned urge Hertfordshire County Council to maintain their current position as to the ownership of the land on the former Radlett Aerodrome, and not to sell or lease it to HelioSlough, for the development of a Strategic Rail Freight Interchange.

The petition was presented at the the meeting of the County Council on 26 March 2013 and the following extract from the minutes shows the decision:

Standing Order 15: Doug Hirst presented a petition of over 10,000 signatures urging “Hertfordshire County Council to maintain their current position as to the ownership of the land on the former Radlett Aerodrome, and not to sell or lease it to HelioSlough, for the development of a Strategic Rail Freight Interchange”.

 

R I N Gordon, Leader of the Council and Executive Member for Resources and Economic Wellbeing, received the petition and gave an initial response.

 

Before Council considered the motion below the Chief Legal Officer advised Council as follows:

 

“The function of deciding on behalf of the County Council whether to enter into a s106 Agreement and/or to dispose of the County Council’s land is one for the Cabinet to take as the Executive and not for County Council. When coming to that decision Cabinet will have to take into account all relevant matters and leave out irrelevant considerations and take into account the Council’s fiduciary duties. Cabinet on 25 February authorised officers to undertake further work which will enable Cabinet to make a proper and informed decision in relation to this matter. When this matter is brought to and considered by members at Cabinet or Panel members must consider the issues as then before them with an open mind taking into account any relevant issues that are raised and officer advice at that time.”

 

The following motion proposed by R I N Gordon and duly seconded was CARRIED UNANIMOUSLY:

 

“County Council

 

1. commends the promoters of the petition for achieving over 10,000 signatures in support of their plea to prevent Helioslough from developing a Rail Freight Interchange on the former Radlett Aerodrome

 

2. endorses the resolutions it agreed unanimously on 26 February 2013

 

3. recognises that officers are not yet in a position to report to members in sufficient detail for Cabinet to make rational and fully informed decisions on these important and complex matters

 

4.notes that, as authorised by Cabinet, the Chief Executive has requested an extension to the amended ‘deadline’ of 28 March 2013 arising from paragraph 46 of the Secretary of State’s letter of 20 December 2012 and that he has yet to respond substantially to this request

 

5. refers the petition to Cabinet for consideration alongside the officers’ advice under stage two of the three stage process agreed by Cabinet on 25 February 2013

 

6. asks Cabinet to report any decision it makes on this matter to County Council.”
